The article L7 1123-10 says: "The employee linked to the modeling agency by an employment contract is entitled to compensation in lieu of paid leave for each service, regardless of the duration thereof.
The amount of compensation, calculated based on this duration, cannot be less than one tenth of the total remuneration due to the employee. The compensation is paid at the end of the service."

So according to the definition of these articles there are no kind of freelance models, but only professional models licensed by an agency.

So if we stick to the labor code, a model who calls herself "amateur" or worse "semi-pro" cannot be paid whether with or without a contract, because she becomes an undeclared worker, which is illegal. . Especially since for a photographer who accepts a workshop with financial compensation, could have serious criminal consequences. As said above, some circumvent the law by declaring themselves self-employed in order to be able to invoice photographers, but as a result it is they who incur criminal prosecution because the status of "free model" does not yet exist in France .

The article L7123-2-1 precise : "The exercise of the modeling activity is conditional on the issue of a medical certificate. This certificate certifies that the overall assessment of the state of health of the model, assessed in particular with regard to her body mass index, is compatible with the exercise of his profession.
